         Intertribal Treatment Center Policies and Procedures
                    
                Client Rights


  The people whom InterTribal serves are among societies most powerless and disenfranchised. This vulnerable
  clientele must be protected from exploitation - both conscious acts and unintentional ones. Intertribal acknowledges
 a systematic and uniform code of client rights in an effort to respect the human dignity of the individuals we serve.

  To be informed in advance about care and treatment and of any changes in care and treatment that may affect the
 client's well being. 

1.      To self direct activities and participate in decisions regarding care and treatment.

2.      To confidentiality of all records, communications, and personal information. 

3.      To examine the results of the most recent survey of the facility conducted by representatives of the Department of  Health  and Human Services;

 

4.      To be free of restraints except when provided as in 175 NAC 18-006.14;

5.      To be free of seclusion in a locked room, except as provided in 175 NAC 18-006.14 and except in cases of
     civil protective custody;

6.      To be free of physical punishment;

7.      To exercise his or her rights as a client of the facility and as a citizen of the Unites States;

8.      To be from arbitrary transfer or discharge.

9.      To be free from involuntary treatment, unless the client has been involuntarily committed by appropriate
    court order and  except in cases of civil protective custody.

10.  To be free from abuse and neglect  and misappropriation of their money and personal property; and

11.  To be informed prior to or at the time of admission and during stay at the facility of charges for care,
  treatment, or related  charges;

12.  To privacy in written communication including sending and receiving mail consistent with individualized
  service plans.

13.  To receive visitors as long as this does not infringe on the rights and safety of other clients and is consistent
  with individualized  service plans.

14.  To have access to a telephone where calls can be made without being overheard when consistent with
  individualized service  plans. (Clients can make one personal call each Tuesday evening after admission).

15.  To retain and use personal possessions, including furnishings and clothing as space permitted, unless to
  do so would infringe  upon the rights and safety of other clients.  (Admission packet contains a list of
  permitted and prohibited items).
 

16.  Will be served without regard to race, color, national origin, religion, economic status, age, marital status,
  or gender. Provided Intertribal can provide the types of medical and supportive services needed by the client,
  disability will not be a factor in admission of a client. If Intertribal cannot provide those services, it will
  take every feasible step to ensure the client gets those services needed from a center which can provide
 appropriately for the care of the client.  Inpatient Clients must be American Indian or Alaskan Native.               

a) A client will not be denied admission solely because of the number of previous admissions to the program. If the program cannot provide the services needed by the client, the client will be referred, whenever possible, to a
 program which can meet the clients’ needs. If a client refuses to abide by the rules of the program and accept
his or her responsibilities as outlined, the client maybe denied admission to the program or dismissed from
 the program. 

b) Whenever a client is refused admission, this will be noted in the log to monitor requests for admission.
 The date, time of day, staff person denying admission and reason for denial will be documented. If requested
in writing by the person, the reason for admission denial will be presented to them in writing by the program
director;

17.  Without due process of law, the client will not be deprived of civil, personal,                  

      Or political right by the Staff.

18.  Client has the right to consult and communicate with his/her attorney,   

      physician, caseworker, and referring counselor.  This can be by phone, written     

      communication, or visitation.  If client is visited by any of the above, a room    

      will be made available so client can maintain the privacy of the communication.

19. Client has the right to engage in or refuse to engage in spiritual and religious 

      activities including sweat lodges and other culturally related spiritual

      Activities, unless clinically contraindicated.  A client may attend these

      activities in the company of an approved adult.

20.  A copy of the agency's fee schedule will be posted in the admitting office and written copy of the fee schedule
 will be provided  to each client at intake if the client so requests.  (This is only applicable to our Outpatient
  clients as no fee is charged our Inpatient clients).

21.Client has the right to expect to be in a safe environment where he/she will not   

      be subjected to violence or threats of violence; sexual harassment; or     

      somebody being under the influence of alcohol and/or other mood altering 

      chemicals.  This includes the client’s peers and Staff.

22.  To voice complaints and file grievances without discrimination or reprisal    

      and to have those complaints or grievances addressed.
